Developer/Owner: Magnificent Workz Business Solutions Inc. ("Company," "we," "us," or "our")

1. Agreement and Acceptance of Terms

By downloading, installing, accessing, or using the One Ledger Notary eJournal application on any iOS or iPadOS device, you ("User," "Notary," or "you") agree to be bound by these Terms and Conditions ("Terms" or "EULA").

If you do not agree to all of these Terms, do not download, install, or use the App. These Terms constitute a binding legal agreement between you and Magnificent Workz Business Solutions Inc.

2. Description of Service & Local Storage Architecture

One Ledger Notary eJournal is a mobile digital logbook utility designed to assist commissioned Notaries Public in organizing, calculating fees for, and recording notarial acts.

• Local On-Device Architecture: The App functions primarily using an offline-first, local-storage model via Apple’s native SwiftData framework.

• Zero Cloud Storage: The Company does not host, back up, transmit, view, or store your notarial journal records on remote servers owned or operated by Magnificent Workz Business Solutions Inc.

• Control of Data: You maintain sole ownership and physical control over all data created within the App on your local device.

3. Notary Compliance and Legal Responsibility Disclaimer

CRITICAL NOTICE TO NOTARIES PUBLIC:

The App is a digital tool provided for record-keeping assistance only. Magnificent Workz Business Solutions Inc. does NOT provide legal advice, official notary commissioning services, or guarantees of statutory compliance.

1. State and Jurisdictional Rules: You are solely responsible for ensuring that your use of a digital or electronic journal complies with the specific Notary Public laws, administrative codes, and Secretary of State (or equivalent authority) regulations in your commissioning state, territory, or country.

2. Acceptability of Electronic Journals: Certain states or jurisdictions strictly require paper journals, specific sequential numbering formats, tamper-evident digital signatures, or specific hardware setups. You are responsible for verifying whether your state permits mobile application journals prior to using this App for official acts.

3. Accuracy of Data: You remain solely responsible for verifying the identity of signers, inspecting valid identification documents, administering oaths, collecting required statutory fees, and ensuring all required fields are accurately recorded.

4. Independent Duty: Using this App does not relieve you of any statutory duty, liability, or personal bond requirements imposed on you as a commissioned Notary Public.

4. Subscriptions, Purchases, and Free Trials

Certain features of the App require a paid subscription or license purchased through Apple’s App Store (StoreKit).

A. Subscription Tiers

The App offers the following purchase options:

• Weekly Subscription: $4.99 per week (includes a 7-day free trial for first-time subscribers).

• Monthly Subscription: $9.99 per month.

• Yearly Subscription: $99.00 per year.

• 5-Year Extended License: $429.00 (processed as a non-renewing subscription).

• 10-Year Extended License: $699.00 (processed as a non-renewing subscription).

B. Free Trial

If offered, a 7-day free trial gives you access to full subscription features. Unless you cancel at least 24 hours before the end of the 7-day trial period through your Apple ID account settings, your account will automatically be charged the applicable subscription fee for the selected plan.

C. Auto-Renewal and Payment Processing

• Apple ID Billing: All billing, payment collection, and subscription renewals are handled exclusively by Apple Inc. through your Apple ID account.

• Automatic Renewal: Auto-renewable subscriptions (Weekly, Monthly, Yearly) automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

• Non-Renewing Plans: The 5-Year and 10-Year plans are single-payment, non-renewing purchases. Upon expiration of the 5-year or 10-year term, access to paid entry creation will lapse unless renewed.

D. Promotional Codes

Promotional offer codes must be redeemed through Apple's native offer code redemption interface. Discount codes apply strictly to the specific terms set forth in the offer and revert to standard pricing upon renewal unless otherwise specified.

E. Refunds and Cancellations

All financial transactions are governed by Apple's App Store terms. Magnificent Workz Business Solutions Inc. does not process refunds directly. To request a refund or cancel a subscription, you must manage your purchase directly through your Apple ID account settings or contact Apple Support.

5. Device Security, Data Retention, and Backups

Because your journal entries are stored locally on your device:

1. Record Retention Responsibility: Notary Public laws in many jurisdictions require you to retain your notarial journal for a specific term of years (e.g., 5, 10, or 21 years) or permanently. You are solely responsible for backing up your device (e.g., via Encrypted iCloud or iTunes Backup) and preserving your journal records to meet state retention mandates.

2. Data Loss: Magnificent Workz Business Solutions Inc. shall NOT be held liable for any loss, corruption, or destruction of your journal data resulting from device damage, loss, theft, software updates, app deletion, hardware failure, or failure to perform backups.

3. Device Security: You must maintain adequate physical and digital security over your device (including passcodes, FaceID, or TouchID) to protect sensitive signer personal information recorded in your journal entries.

6. Intellectual Property Rights

1. Ownership: The App, including its code, graphics, user interface, brand assets ("One Ledger," "Notary Knowledge," "Know Notary", "Little Notary Derrick", "Marylyn Lee Trotter", "Marylyn's 90 Seconds of Notary", "Eddie Montes Travis", icons, and proprietary fee-calculation workflows, is the exclusive intellectual property of Magnificent Workz Business Solutions Inc. and is protected by copyright, trademark, and trade secret laws.

2. Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your professional or personal notary activities on devices you own or control.

3. Restrictions: You agree that you will not:

   • Copy, decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.

   • Modify, translate, or create derivative works based on the App.

   • Rent, lease, lend, sell, redistribute, or sublicense the App.

7. Third-Party Services and External Links

The App may contain links to external third-party websites, training resources, trivia platforms (e.g., Notary Knowledge), podcast directories, or daily inspirational content.

• These external links are provided for convenience and educational purposes only.

• Magnificent Workz Business Solutions Inc. does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or platforms.

• You access external resources entirely at your own risk.

8. Disclaimer of Warranties

PLEASE READ THIS SECTION CAREFULLY:

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MAGNIFICENT WORKZ BUSINESS SOLUTIONS INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, BUG-FREE, OR SECURE.

• WARRANTIES THAT THE APP WILL GUARANTEE COMPLIANCE WITH THE NOTARY PUBLIC LAWS OF ANY SPECIFIC JURISDICTION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAGNIFICENT WORKZ BUSINESS SOLUTIONS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNATIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• LOSS OF NOTARIAL RECORDS, JOURNAL DATA, OR FINANCIAL LOGS.

• LOSS OF REVENUE, PROFITS, OR GOODWILL.

• FINES, PENALTIES, OR REVOCATION OF YOUR NOTARY COMMISSION ISSUED BY ANY STATE GOVERNING BODY.

• EXPENSES RELATING TO LITIGATION ARISING FROM INVALID OR PROTESTED NOTARIAL ACTS.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE APP EXCEED THE ACTUAL AMOUNT PAID BY YOU TO US FOR THE APP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR $100.00 USD, WHICHEVER IS LESS.

10. Indemnification

You agree to defend, indemnify, and hold harmless Magnificent Workz Business Solutions Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

1. Your access to or use of the App;

2. Your performance of any notarial act, whether accurate, inaccurate, legal, or fraudulent;

3. Your failure to comply with local, state, federal, or international notary laws and regulations;

4. Your violation of any third-party rights, including privacy or intellectual property rights; or

5. Your violation of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without giving effect to any principles of conflicts of law.

Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the federal or state courts located in the Commonwealth of Virginia, and you irrevocably submit to the personal jurisdiction of such courts.

12. Severability and Waiver

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time in our sole discretion. We will indicate updates by modifying the "Last Updated" date at the top of these Terms. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.

1. Introduction and Scope

Magnificent Workz Business Solutions Inc. ("we," "us," or "our") built the One Ledger Notary eJournal app to serve as a secure, compliant, and offline-capable tool for Notaries Public. We respect your privacy and are committed to protecting it through our compliance with this policy.

This Privacy Policy explains our practices regarding the collection, use, disclosure, and protection of information that is processed through the App. This policy is designed to comply with comprehensive global privacy standards, including the General Data Protection Regulation (GDPR) in the European Union and the United Kingdom, the California Consumer Privacy Act (CCPA) as amended by the CPRA, the Virginia Consumer Data Protection Act (VCDPA), the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA), and the privacy frameworks of all 50 U.S. states and international jurisdictions.

2. Our Core Privacy Philosophy: "Zero Server Collection"

The fundamental architecture of One Ledger Notary eJournal is built on Local On-Device Storage.

We do not collect, transmit, store, or view your notarial journal data on our servers. All information entered into the App—including the personal information of your signers, identification data (such as driver's license scans), signatures, and notarial act details—is saved locally to your physical Apple device (iPhone or iPad) using Apple’s native SwiftData framework.

Because we do not transmit this data to any external server owned by Magnificent Workz Business Solutions Inc., we cannot sell, share, or monetize your journal data, nor can we produce it in response to a subpoena, as we simply do not possess it.

3. Information Processed by the App

While the App processes data to function, this processing happens locally on your device. The categories of information processed locally include:

• Notary Profile Information: Your name, commission details, state of commission, and contact information.

• Signer Information: Names, addresses, signatures, and identification details (including barcode scans) of the individuals for whom you perform notarial acts.

• Geolocation Data: If permitted by you, the App may log the geographic coordinates of the notarial act to comply with certain state journal requirements. This location data is saved strictly to your local journal entry.

• Financial Log Data: Fee calculations, mileage, and travel expenses related to your notarial acts.

Apple App Store Data: We may receive anonymized, aggregated analytics from Apple regarding app downloads, crash reports, and usage metrics. This data does not personally identify you or your signers.

4. Biometric Data (FaceID & TouchID)

To secure your digital journal, One Ledger Notary eJournal utilizes Apple’s native biometric authentication (FaceID or TouchID).

• No Access to Biometrics: Magnificent Workz Business Solutions Inc. does not collect, capture, store, or transmit your biometric data.

• Secure Enclave: All biometric verification is handled securely by the operating system (iOS/iPadOS) via the device’s Secure Enclave. The App merely asks the operating system if the user is verified; it never receives the underlying fingerprint or facial map.

5. Subscriptions and Payments (StoreKit)

If you choose to purchase an auto-renewable or non-renewing subscription (e.g., Weekly, Monthly, Yearly, 5-Year, or 10-Year plans), all financial transactions are handled entirely by Apple via the App Store (StoreKit).

• We do not collect or store your credit card numbers, billing address, or direct financial information.

• Apple processes your payment and securely provides our App with an anonymous digital receipt to unlock your premium features.

6. Third-Party Links and Resources

The App contains a "Free Notary Resources" hub which provides external links to our ecosystem, including podcasts, the Know Notary platform, training websites, and daily inspirational quotes. If you click these links, you will be directed outside of the App to external web browsers (e.g., Safari) or external apps (e.g., Apple Podcasts). We are not responsible for the privacy practices of these external platforms, and we encourage you to read their respective privacy policies.

7. United States Privacy Rights (All 50 States, including CCPA/CPRA)

Various U.S. states have enacted comprehensive consumer privacy laws (such as in California, Virginia, Colorado, Connecticut, Utah, and others). Under these laws, residents generally hold the right to:

• Right to Know/Access: Request disclosure of the personal data collected about them.

• Right to Delete: Request deletion of their personal data.

• Right to Correct: Request correction of inaccurate personal data.

• Right to Opt-Out: Opt-out of the sale or sharing of personal data for cross-context behavioral advertising.

Our Compliance: Because Magnificent Workz Business Solutions Inc. does not collect your data off your device, we do not "sell" or "share" your personal information or your signers' information under the definition of any U.S. state law. You have absolute control over your data; you may delete your journal entries or the entire App directly from your device at any time.

8. European (GDPR), UK, and International Privacy Rights

If you are located in the European Economic Area (EEA), the United Kingdom (UK), Canada, Australia, or other jurisdictions with comprehensive data protection laws, you are afforded specific rights regarding your personal data (e.g., the right to access, rectification, erasure/right to be forgotten, restriction of processing, and data portability).

Our Compliance: The core principle of the GDPR and similar laws is data minimization and security. By utilizing a strict local-storage architecture, we practice "Privacy by Design." Because we do not upload your data to our servers, we do not act as a "Data Controller" or "Data Processor" for your notarial journal entries. The user (the Notary) acts as the Data Controller of their own journal on their own physical device.

9. Data Retention and Notary Compliance

As a Notary Public, you are legally bound by the data retention laws of your commissioning state or country regarding how long you must keep your journal records (often 10 years or more).

• It is your sole responsibility to maintain the physical security of your iPhone or iPad, maintain device backups via iCloud or iTunes, and ensure your device passcode is secure to comply with your local notary regulations.

• If you delete the App from your device without backing it up, your journal data will be permanently destroyed.

10. Children’s Privacy

One Ledger Notary eJournal is a professional business tool and is not directed at children under the age of 18. We do not knowingly process personal information from minors. If a user utilizes the App to notarize a document for a minor (where legally permitted), that data remains strictly on the local device.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in legal requirements or our app's functionality. We will notify you of any changes by updating the "Effective Date" at the top of this policy, and where required by Apple App Store guidelines or local law, we may provide a more prominent notice within the App.
